The obligation not to discriminate is imposed with priority on all authorities, state agents, but also economic agents.
What is discrimination?
The different treatment of persons in identical or comparable situations and the lack of an objective justification for such treatment.
Forms of discrimination on the labor market:
Discrimination in employment can be achieved through: job advertisements that exclude people without justification; the refusal of employment determined by the person’s belonging to a criterion or characteristics not relevant to the position.
Discrimination during employment relationships can consist of: unjustified refusal to participate in professional qualification courses; unequal remuneration for the same work; failure to provide reasonable accommodation; bullying; incitement to discrimination; unfair dismissal.
How can discrimination be proven?
The victim of discrimination must provide evidence of the difference in treatment
What can the person who believes they have been subjected to discrimination do?
Bringing the author of the discrimination to criminal liability; Claiming monetary damages in court; Cancellation of the administrative act.
Measures to ensure equal opportunities on the labor market
Equal treatment of job seekers; access to the consultation of demand and supply on the labor market; privacy regarding race, nationality, ethnicity, religion, gender, and sexual orientation; preventing and combating mobbing and bullying behaviors.
